The Federal Act on Gender Equality (GlG, SR 151.1) aims to uphold the constitutional right to equal pay for work of equal value (Art. 8 para. 3 Federal Constitution).
Companies employing 100 or more employees at the beginning of a calendar year are – regardless of their legal form, required to conduct an internal wage equality review for that year (Art. 13a para. 1 GlG). The first review had to be completed by the end of June 2021. Subsequently, companies within the legal scope must repeat this analysis every four years (Art. 13a para. 2 GlG), unless the analysis demonstrates compliance with equal pay.
In public procurement in particular, companies are increasingly required to prove that they comply with the principle of equal pay. Otherwise they will not be considered for procurement contracts. Companies can verify equal pay using a tool that is available free of charge – the Logib tool – free of charge. If required (e.g. for public procurement), the correct application of the equal pay tool must be confirmed by an external inspection or testing body. In this context, the inspection or testing body is usually also tasked with checking that the working conditions are in line with local and industry standards.
